1.- ORGANISER AND PURPOSE OF THE PROMOTION

S.A. DAMM, with registered office at C. Rosselló, 515, with CIF A08000820, is organising a promotion called “MALLORCA LIVE FESTIVAL” (hereinafter, the “PROMOTION”), in order to offer an incentive to consume and promote the products sold under the brand ‘ESTRELLA DAMM’, owned and registered by S.A. DAMM.

 

2.- TERRITORIAL SCOPE OF THE PROMOTION AND ENTITLED PERSONS

The PROMOTION is aimed at end consumers who present 30 bottle neck labels (25 cl and 33 cl) of ESTRELLA DAMM beer sold in bars and restaurants in the Balearic Islands.

Only persons over 18 years of age residing in the Balearic Islands may participate in the PROMOTION. If a person obtains two tickets, the person accompanying them must also be over 18 years of age.

S.A. DAMM may request at any time that the winners reliably prove their personal details by providing valid and current ID or foreigner identification number.

Any person working for S.A. DAMM and/or distributors and/or bars and restaurants, or their relatives, as well as any other person directly or indirectly related to creating and producing the PROMOTION is expressly excluded from this PROMOTION.

Entries that do not meet these requirements will be automatically discarded, even if they have won a prize.

 

3.- PROMOTION DURATION

The PROMOTION will begin on 10 March 2025 and end on 4 May 2025, both inclusive.

 

4.- PROMOTION MECHANICS

End consumers must redeem a minimum of 30 codes on the website estrelladamm.com/mallorcalive. Each of these codes can be found on the neck of ESTRELLA DAMM beer bottles (25 cl and 33 cl) sold from 1 March 2025 within the Balearic Islands.

The first 2,250 end consumers to redeem the 30 codes will get a ticket to choose from for 12, 13 and 14 June 2025 for the Mallorca Live Festival, with 750 tickets available each day. The promotion’s mechanics mean that, once the 30 codes have been redeemed on the website estrelladamm.com/mallorcalive, the user must select the day of the festival they want to get a ticket for. The option to choose a day may be limited for some award winners when the 750 tickets allocated for each of the indicated days are sold out. A promotional code to obtain tickets will not be assigned until the user has finalised the day selection process, so there is a risk that tickets could sell out.

On selecting the option “Get ticket” a code will be generated which should be copied to the festival's “ticket office” website, where a ticket will be allocated to you for €0. The ticket will not be assigned to the user until they paste the code into the corresponding box in the ticket office and finalise the process.

Starting from the 2,251st end consumer (the 2,251st end consumer included), those who redeem 30 codes on the estrelladamm.com/mallorcalive website within the promotional period established in the legal terms and conditions 3, will be entered into a draw for 750 tickets for the concerts on 12 June 2025 at the Mallorca Live Festival. This draw will take place on 12 May 2025. Users can enter as many codes as they like in the draw. They can only get a maximum of 2 tickets between both phases.

During the code redemption process on the promotional website estrelladamm.com/mallorcalive, the end consumer will be asked for the following details, solely for purposes related to this promotion:

5.- PRIZE

All participants in the promotion will be eligible to win a total of 3,000 individual tickets for the concerts of the 2025 MALLORCA LIVE FESTIVAL, to be held on 12, 13 and 14 June 2025 in the municipality of Calvià (Mallorca). Of the 3,000 tickets, the first 2,250 will be allocated directly, distributed as follows: 750 for Thursday 12 June 2025, 750 for Friday 13 June 2025 and 750 for Saturday 14 June 2025. The remaining 750 will be awarded by a draw among participants who are not among the first 2,250 entries and who correctly redeem the 30 codes within the promotional period.

Only two entries per person will be allowed, meaning only a maximum of two tickets per participant will be available for the concerts of the Mallorca Live Festival on 12, 13 and 14 June 2025.

In the event that, once the promotion has ended, there are prizes remaining to be distributed, S.A. DAMM may declare the promotion void and dispose of the prizes in the way it deems most appropriate.

 

6.- THE DRAW

Before the notary of the city of Barcelona, José-Alberto Marín Sánchez, at Carrer 268 Diputació, entl., who will carry out the draw for the 750 tickets corresponding to the entries starting from the 2,251st end consumer (including the 2,251st end consumer).

One winner will be chosen for each individual ticket for the concerts on 12 June at the festival.

In the event that the winner cannot be contacted, the prize will be declared void.

 

7.- LIABILITIES

S.A. DAMM is not liable for incidents and events of any kind caused by a failure in the computer programme, if applicable, or by a case of force majeure (for example, impossibility of registering a user, interruption or loss of a call, etc.) nor of incidents arising from cases of force majeure resulting from causes such as a fault in the telephone, computer or electrical network, caused by natural external agents (atmospheric, climatological or due to poor functioning of the companies supplying these services).

S.A. DAMM is also not liable for the impossibility of registering a user due to an error in capturing their personal data, as a consequence of entries that, in their case, are intangible, incomplete, erroneous or false.

 

8.- PROTECTION OF PERSONAL DATA

By means of the promotional mechanics described, and in compliance with the applicable regulations, it is hereby stated that the data of the promotion’s participants will be processed by S.A. DAMM  for the purpose of managing the promotion and awarding the prizes to the corresponding winners.

By completing the promotion form, the participant also gives their express consent for the processing of their personal data to manage, attend to and offer them the requested services in accordance with the information provided at the time of registering for the promotion with regard to the purpose, legitimisation and recipients of the data.

Fields marked with an asterisk on the form are strictly required in order to participate in the promotion.

Participants in this promotion may exercise their rights to access, rectification, erasure and portability of their data, as well as the right to restriction or opposition of its processing by writing to the following postal address: S.A. 9.- RESERVATIONS AND LIMITATIONS

S.A. DAMM reserves the right to cancel or suspend this PROMOTION, or to change some of the conditions if, for technical or any other reasons beyond its control, it cannot be carried out normally, in accordance with the provisions of these rules.

Similarly, S.A. DAMM may declare a user's participation to be null and void if it detects irregularities in the identifying data.

Also, S.A. DAMM reserves the right to justifiably eliminate any user who defrauds, alters or disables the proper functioning and the normal and regulatory course of this PROMOTION.

 

10.- APPLICABLE LAW AND JURISDICTIONAL SUBMISSION

The promotions of S.A. DAMM are governed by current legislation in Spain.

For any controversy that may arise in the interpretation and application of these rules, both S.A. DAMM and the participants in this PROMOTION submit to the competent courts and tribunals.

S.A. DAMM reserves the right to take legal action against those persons who carry out any type of act that could be considered manipulation or falsification of the PROMOTION.

 

11.- ACCEPTANCE OF THE RULES

Potential participants are informed that the simple fact of taking part in the PROMOTION implies full acceptance of these rules. Any statement to the contrary by the participant will result in their exclusion from the PROMOTION and S.A. DAMM will be released from compliance with the obligation established between both parties.

The rules of this PROMOTION are filed with the Notary Association of Barcelona, Mr Jose-Alberto Marín Sánchez, Carrer Diputació, 268, entl., and are freely available to participants.
