1. ORGANISER AND PURPOSE OF THE PROMOTION

S.A. DAMM with business address at c/ Roselló 515 and Tax ID number (CIF) A08000820 is holding a promotion called “MALLORCA LIVE FESTIVAL” (hereinafter the “PROMOTION”), in order to incentivise consumption and dissemination of the products marketed under the “ESTRELLA DAMM” brand, owned and registered by S.A. DAMM.

 

2. TERRITORIAL SCOPE OF THE PROMOTION AND ELIGIBLE PARTICIPANTS

The PROMOTION is geared towards end-consumers who submit 25 neck labels from bottles (33 cl and 20 cl) of ESTRELLA DAMM beer sold in bars and restaurants on the Balearic Islands.

Only residents of the Balearic Islands who are 18 years of age or older may participate in the PROMOTION.

Any employees of S.A. DAMM and/or distributors and/or bars or restaurants, and their family members, or anyone directly or indirectly involved with creating or carrying out the PROMOTION are expressly prohibited from taking part.1

Any entries that do not meet any or all of these requirements shall be automatically disqualified, even if they win.

 

3. TEMPORAL SCOPE OF THE PROMOTION

The PROMOTION will begin on 14 March 2022 and end on 22 May 2022, inclusive.

 

4. PROMOTION MECHANICS

The final consumer must enter at least 25 codes into the website estrelladamm.com/mallorcalive. The codes are found on the neck label of bottles of ESTRELLA DAMM beer (33 cl and 20 cl) sold from 14 March 2022 in the geographic area in question.

The first 3,000 end-consumers to enter 25 codes will get a ticket for the concerts on 24 June 2022 of the Mallorca Live Festival. The promotion mechanics are such that, once 25 codes have been entered on the estrelladamm.com/mallorcalive website, the user must click on the “Get ticket” button and will be redirected to the festival’s ticketing website, where they can obtain a ticket for €0. Users will not be assigned a ticket until they click on “Get ticket”.

 

 From end-consumer number 3,001 (including end-consumer 3,001), anyone who enters 25 codes on the estrelladamm.com/mallorcalive website within the time frame established in condition 2 of these rules will be entered into a draw, giving away 2,000 tickets to the concerts on 24 June 2022 of the Mallorca Live Festival. The draw will be held on 29 May 2022.

In entering the codes on the estrelladamm.com/mallorcalive promotion website, users will be asked, for purposes solely related to this promotion, for the following data:

    Email address (contact)

    Name and surname

    Province and postcode

 

5. PRIZE

In total, there are 5,000 tickets for the concerts of the first day of the Mallorca Live Festival, on 24 June 2022 in Calvià (Mallorca), to be given out among all the participants in the promotion. Of the 5,000 tickets, the first 3,000 shall be awarded directly. The remaining 2,000 shall be awarded through a draw, which shall be held with the participants who properly entered 25 codes by the promotion deadline but were not among the first 3,000 to do so.

Each person may only enter twice, meaning each individual may only win two tickets to the opening concert of the Mallorca Live Festival.

If any prizes are not awarded at the conclusion of the promotion, S.A. DAMM may declare them null and void and use them as it sees fit.

 

6. HOLDING THE DRAW

Barcelona Notary Public José-Alberto Marín Sánchez, Carrer de la Diputació 268, entlo., will hold the draw to award the 2,000 tickets to participants from end-consumer 3,001 (including end-consumer 3,001). 

For each individual ticket for the concerts on 24 June of the festival, one winner will be chosen.

If the winner cannot be contacted, the award will be declared null and void.

 

7. RESPONSIBILITIES

S.A. DAMM shall not be held liable for any incidents or occurrences of any sort arising from issues in the computer programming, if applicable, due to force majeure (for example, a user being unable to register, call being dropped or not picked up, etc.), nor for any incidents in situations of force majeure arising from issues such as problems with the phone, computer or electric networks, caused by external natural forces (weather, climate, or deficient operations of the companies supplying said services).

Nor shall S.A. DAMM be liable for a user being unable to register due to an error in entering their personal data, as a result of writing that is illegible, incomplete, erroneous or false.

Likewise, S.A. DAMM shall not be liable for any incidents in situations of force majeure arising from issues such as problems with the phone, computer or electric networks, caused by external natural or atmospheric forces, or deficient operations of the companies supplying said services.

 

8. PROTECTION OF PERSONAL DATA

The promotion mechanics described, as per current regulations, include informing participants that their data shall be processed by S.A. DAMM in order to manage the promotion and award the prizes to the corresponding winners.

Likewise, by filling in the promotion form, participants are expressly consenting to the processing of their data to manage, assist and provide the services requested as per the information provided during the promotion registration process regarding the purpose, lawfulness and recipients of their data.

The fields marked with an asterisk on the aforementioned form are strictly necessary to participate in the promotion.

Participants in the promotion may exercise their rights to access, rectification, erasure, opposition, portability and limitation of the processing of personal data to the following post address: S.A. 9. RESERVATIONS AND LIMITATIONS

S.A. DAMM reserves the right to declare this PROMOTION null and void, to suspend it or to change any of its conditions if, for technical or other reasons beyond its control, it is not possible to properly carry it out, as per the provisions of these rules.

Likewise, S.A. DAMM may disqualify a user if any irregularities are detected in their personal data.

Furthermore, S.A. DAMM reserves the right to justifiably disqualify any users attempting to cheat, alter or hamper the normal course and proper functioning of this PROMOTION.

 

10. APPLICABLE LAW AND JURISDICTION

S.A. DAMM promotions are governed by current Spanish law.

Both S.A. DAMM and the participants in this PROMOTION agree to take up any issues that may arise in the interpretation an application of these rules with the competent Courts.

S.A. DAMM reserves the right to take legal action against anyone doing anything that may be construed as manipulation or falsification of the PROMOTION.

 

12. ACCEPTANCE OF THE RULES

All potential participants are hereby notified that merely taking part in the PROMOTION implies full acceptance of these rules. Any participants that manifest otherwise shall be disqualified from the PROMOTION and S.A. DAMM shall be exempt from fulfilling its obligation with said individual.

The rules of this PROMOTION are on file with Barcelona Notary Public José-Alberto Marín Sánchez, Carrer de la Diputació 268, entlo, and freely available to participants.
