1. PROMOTER AND PURPOSE OF THE PROMOTION

S.A. DAMM, with registered address at c/ Rosselló, 515, and Spanish tax identification number A08000820, will organise a promotion called “MALLORCA LIVE FESTIVAL” (hereinafter referred to as the “PROMOTION”), with the aim of offering an incentive for the consumption and publicity of the products marketed under the brand name “ESTRELLA DAMM”, owned and registered by S.A. DAMM..

 

2. TERRITORY OF THE PROMOTION AND AUTHORISED PERSONS

The PROMOTION is aimed at end consumers who submit 25 bottleneck labels from bottles (33 cl and 20 cl) of ESTRELLA DAMM beer sold in bars and restaurants in the Balearic Islands.

The PROMOTION is open to persons over 18 years of age who are residents of the Balearic Islands. In the event that one person obtains two tickets, the accompanying person must also be over 18 years of age.

Any person working for S.A. DAMM and/or distributors and/or bars and restaurants, or their relatives, as well as any other person directly or indirectly related to the creation and execution of the PROMOTION, are expressly excluded from this PROMOTION.

Any entries that do not meet these requirements will be automatically disqualified, even if they have won.

 

3. DURATION OF THE PROMOTION

The PROMOTION will begin on 18 March 2024 and end on 5 May 2024, both inclusive.

 

4. FUNCTIONING OF THE PROMOTION

End consumers must submit a minimum of 25 codes on the website estrelladamm.com/mallorcalive. Each code will be found on the bottleneck labels of the bottles of ESTRELLA DAMM beer (33 cl and 20 cl) that will be available from 1 March 2024 within the aforementioned territory.

The first 2,250 end consumers who obtain the 25 codes will receive a ticket of their choice for the MALLORCA LIVE FESTIVAL on the 13, 14 or 15 June 2024, with 750 tickets available for each day. The promotional process consists of the following: once the 25 codes have been entered on the website estrelladamm.com/mallorcalive, the user will be able to select the day of the festival for which they want to obtain the ticket. However, the possibility of choosing the day of the festival may be limited for some winners once the 750 tickets for each of the specified days have been claimed. In the event that the user does not complete the process of selecting a day, they will not be assigned a promotional code to obtain a ticket, and they therefore risk the supply of tickets running out.

Subsequently, by selecting the “Get ticket” option, a code will be generated which must then be copied to the festival’s ticket website, where a ticket will be awarded at a price of €0. If the user does not enter the code into the corresponding field on the ticket website and complete the process, the ticket will not be awarded.

From end consumer 2,251 onwards (including end consumer 2,251), those who enter 25 codes on the website estrelladamm.com/mallorcalive, within the promotional period specified in condition number 2, will be entered into a draw for 750 tickets for the performances on 13 June 2024 at the MALLORCA LIVE FESTIVAL. This draw will take place on 13 May 2024.

During the process of entering the codes on the promotional website estrelladamm.com/mallorcalive, the following data will be requested from the end consumer, for purposes solely related to this promotion:

5. PRIZE

A total of 3,000 individual tickets for the performances at the MALLORCA LIVE FESTIVAL 2024, to be held on 13, 14 and 15 June 2024 in the municipality of Calvià (Mallorca), will be available to all participants in the PROMOTION. Of the 3,000 tickets, the first 2,250 will be awarded directly, distributed as follows: 750 for 13 June 2024, 750 for 14 June 2024, and 750 for 15 June 2024. The remaining 750 tickets will be distributed through a prize draw involving the participants who fall outside of the first 2,250 entries and successfully submit 25 codes during the promotional period.

Only two entries per person will be allowed, in other words, a maximum of two tickets will be available per participant for the performances on 13, 14 and 15 June at the MALLORCA LIVE FESTIVAL.

In the event that, once the PROMOTION has ended, there are still prizes to be distributed, S.A. DAMM may declare them void and dispose of them in the manner it deems most appropriate.

 

6. PROCEDURE OF THE DRAW

The draw for the remaining 750 tickets, corresponding to the entries made by end consumers 2,251 onwards (including end consumer 2,251), will be performed before the Notary Public of the City of Barcelona, Mr José-Alberto Marín Sánchez, with offices at Carrer Diputació, 268, entresol.

One winner will be chosen for each individual ticket for the performances on 13 June.

In the event that the winner cannot be contacted, the prize will not be awarded.

 

7. LIABILITIES

S.A. DAMM shall not be held liable for incidents and events of any kind caused by a malfunction of the computer program, if applicable, or due to a case of force majeure (for example, inability to register a user, interruption or loss of a call, etc.), nor for incidents arising from force majeure due to causes such as an outage of the telephone, computer or electricity network, caused by natural external agents (atmospheric, climatological or due to substandard operation by the companies supplying these services).

S.A. DAMM shall also not be held liable for the inability to register any user due to an error in the entry of their personal data, as a consequence of pieces of information that, where applicable, are deemed intangible, incomplete, erroneous or false.

 

8. PROTECTION OF PERSONAL DATA

In accordance with the aforementioned functioning of the PROMOTION, and in compliance with the applicable regulations, it is hereby declared that the data of the participants in the PROMOTION will be processed by S.A. DAMM for the purpose of managing the PROMOTION and assigning the prizes to the corresponding winners.

By completing the form for the PROMOTION, participants also consent to the processing of their personal data in order to manage, attend to and offer the requested services in accordance with the information provided at the time of registering for the PROMOTION relating to the purpose, legitimacy and recipients of the data.

The fields highlighted with an asterisk on the form are strictly necessary in order to participate in the PROMOTION.

Participants in this PROMOTION may exercise their rights of access, rectification, erasure and portability of their data, and to restrict or object to the processing of their data by sending a letter to the following address: S.A. 9. RESERVATIONS AND LIMITATIONS

S.A. DAMM reserves the right to cancel or suspend this PROMOTION, or to change any of the conditions, if, for any reason of a technical or other nature beyond its control, it is unable to carry out the normal process of the PROMOTION, in accordance with the provisions of these terms and conditions.

Likewise, S.A. DAMM may declare the participation of a user null and void if it detects irregularities in the identification data.

Furthermore, S.A. DAMM reserves the right to justifiably exclude any user who defrauds, alters or renders useless the proper functioning or the normal and regulatory course of this PROMOTION.

 

10. GOVERNING LAW AND JURISDICTION

The promotions of S.A. DAMM are regulated by the legislation in force in Spain.

For any dispute that may arise in the interpretation and application of these terms and conditions, both S.A. DAMM and the participants of this PROMOTION shall submit to the jurisdiction of the relevant courts and tribunals.

S.A. DAMM reserves the right to take legal action against those individuals who carry out any type of act that may be considered manipulation or falsification of the PROMOTION.

 

11. ACCEPTANCE OF THE TERMS AND CONDITIONS

All participants are informed that the mere fact of participating in the PROMOTION implies full acceptance of these terms and conditions. In the event that the participant declares otherwise, they will be excluded from the PROMOTION and S.A. DAMM will be released from any obligation established between the two parties.

The terms and conditions of this PROMOTION are filed with the Notary Public of the City of Barcelona, Mr José-Alberto Marín Sánchez, with offices at Carrer Diputació, 268, entresol, and are freely available to the participants.
