LEGAL BASES FOR PARTICIPATION COMMON TO ALL S.A. DAMM PROMOTIONS

1. Organising company

S.A. Damm, with registered offices at calle Rosselló, 515, 08025 Barcelona, and Spanish Tax Number A08000820. 

2. Requirements for participation, mechanics and prizes

All persons of legal age who are resident in Spain may participate in the promotion. Employees of the organising company, S.A. Damm, are not permitted to participate. Only entries from users who fulfil the participation requirements outlined hereafter will be considered valid: 

1.     Users must have registered on the www.estrelladamm.com website with a valid and existing email address.

As this competition is a prize draw, the winner will be selected randomly using Random.org or other tools that facilitate the random selection of the winner(s).

Each user can only submit one entry for the competition

The winners will be contacted via an email that will be sent to the email address provided at the time of registration. Once the winners have been announced, each winner will have a period of 5 hours to respond. If a response is not received, a substitute will be contacted automatically and the previous winner will forfeit any claim to the prize.

In the event that the winner is unable to receive the prize, it can be transferred to another person (family member, friend, etc.), but it cannot be exchanged for any other product or service, or for its cash value.

The competition will be active across Catalonia. It will start on Thursday 10th September 2020 at 14.00 h and end on Tuesday 22nd September 2020 at 10.00 h.   

Lead Generation format

Participation in the competition implies the acceptance of the terms and conditions of Lead Generation and authorises S.A. Damm to use the email address of the user to send communications regarding the activity of S.A. Damm.

The prize

We’re giving away 5 pairs of front row* tickets to each of the Estrella Damm La Mercè concerts taking place on the 24^th, 26^th and 27^th at the Fòrum. The concerts are as follows:

The winner will have to choose the concert they want to attend, and the selection will be completely random from among the pool of participants that made the same choice.
 

*Due to the current sanitary situation and regarding capacity issues, the seats could be moved to the second row.

3. Acceptance of the bases

Participation in promotions implies the unconditional acceptance of these general bases. Recognition as a valid participant is subject to compliance with all the requirements established in these legal bases.

4. Publication of the identities of the winners

The winners accept that their names may be published in the media that S.A. Damm considers appropriate. 

5. Intellectual property rights

S.A. Damm can use the texts and content provided by the participants and winners of the competition since participation in commercial promotions implies the transferral of copyright, including all rights of reproduction and distribution, without temporal or geographical limitation.

6. Treatment of data

For the purposes of the provisions of the current regulations regarding the protection of personal data, S.A. Damm notifies you of the existence of an automated file of personal data created as the responsibility of S.A. Damm for the purpose of conducting the maintenance and management of information, training and marketing of the service that is the subject of this promotion and related activities, expressly authorising the sending of communications of a commercial nature regarding the products manufactured and/or sold by S.A. Damm via the address and email address provided, expressly authorising that the data of participants can be transferred to companies that are part of the same corporate group, in accordance with the definition of article 42 of the Commercial Code that relates to the beer sector, bottled water packing, catering and event organisation and for the aforementioned purposes. In addition, you are notified of the opportunity to exercise the rights of access, rectification, cancellation and opposition, and that in order to exercise said rights it is essential that written communication is forwarded to S.A. Damm, c/ Rosselló, 515, 08025 de Barcelona. Participants in this promotion, as a result of their participation, give express consent to receive information of a commercial nature regarding the brands and products manufactured by S.A. Damm. Furthermore, you are also informed that the consent given for the communication of personal data can be withdrawn at any time without retroactive effects.

For the purposes provided by Organic Law 1/1982, of the 5^th of May, regarding the civil protection of the right to honour, personal and familial privacy and personal image, it is established that the acceptance of the prize by the winners implies the express granting of the authorisations contained in the 2^nd article to S.A. Damm to use the names and surnames as well as the images of the winners, in any public or dissemination activity related to this promotion, without transferring to the winners any right to remuneration or the acquisition of any benefit other than the prize itself. Non-acceptance of the above implies an automatic forfeit of the prize.

7. Changes to the legal bases

These bases may be subject to modifications at any time during the course of the promotion if it is considered appropriate.
